Ex-NBA player to be retried in 2010
A Somerset County judge said former NBA player Jayson Williams could continue to remain free on $250,000 bail and declined to sentence him for trying to cover up the 2002 shooting of his limousine driver.
Prosecutors tried to convince the judge this morning that Williams' recent behavior — including a bar fight last month in North Carolina, and an incident in New York where police had to Taser him — made him unpredictable.
But Somerset County Superior Court Judge Edward Coleman noted Williams always showed up for his court appearances, and that to sentence him now risked double jeopardy.
Coleman wants to wait until all the charges are heard, he said in court this morning, according to nj.com."Frankly, the better choice is to not do the sentence until you have the whole case resolved," the judge said.
Williams, 41, is to be retried in 2010 on a charge of reckless manslaughter, according to nj.com, in the shooting death of Gus Christofi. Five years ago a jury acquitted Williams of aggravated manslaughter, but he was found guilty on charges that he'd tried to cover-up the death.
"Frankly, the better choice is to not do the sentence until you have the whole case resolved," the judge said.
