The Supreme Court Tuesday ruled a nearly five-year-old court case involving a former Mercer County Community College dean, whose contract was not renewed, was age discrimination.
By a 6-1 vote, the court decided in favor of Rose Nini, who had worked at the college for 26 years, according to NorthJersey.com.
Three years after her contract expired, the then 73-year-old lodged the lawsuit against Mercer in September 2005. Most recently, she had served as dean of corporate and community programs.
In August 2004, the school's then-president, Dr. Robert Rose "made it very clear to (her) that he thought (she) had no right to be working at (her) age," according to NorthJersey.com.
Mercer contested she was an "at will employee" and worked under several contracts.
Nini, a 79-year-old Princeton Township resident, and Mercer Community College, both wanted the Supreme Court to drop the case, since a settlement had been reached. But that didn't happen with the case holding high public interest, according to the Chronicle of Higher Education.
