After an emergency New Jersey Supreme Court ruling was handed down this week regarding her role as Lt. Governor under the state Constitution, Lt. Governor Kim Guadagno, agreed to “fully replace the governor and yell at teachers and other union members,” should Gov. Christie have to re-enter the hospital or leave the state.
The state government was on the brink of a constitutional crisis this week, when the governor announced his plans to go to the Magnolia State. The governor is scheduled to be out of the state to go to Mississippi to stump for Republican candidates.
The 6-1 decision will avert another constitutional crisis by providing a clear indication of who is “constitutionally required to yell at union members if the governor becomes unavailable or incapacitated”. Only Justice Roberto A. Rivera-Soto dissented due to the fact, that he “…really [does not] give a flying #@&*, because I was not re-appointed, and I left this &^%$’n job as of September 1st anyway”.
Under Article V, Section I, paragraph 6 of the New Jersey Constitution, “In the event of a vacancy in the office of Governor…the Lieutenant Governor shall become Governor, until a new Governor is elected and qualifies.” Article V is silent as to who has the authority to “yell, shout, insult, or abuse union members, the media or members of the legislature,” in the event the governor is incapacitated.
Senate President Sweeney believed that in spite of Article V, that role “fell to him…in [his] authority as leader of the Senate.” Senate Minority Leader Tom Keane, believed that “if anyone is going to yell at teachers or insult the press when Governor Christie is not available, that person has to be a Republican.”
