Vera, your naivete strikes me as incongrous for a professor who is presumably exposed to a lot of legal history. The "she was asking for it" defense is already used widely in the cases you're talking about, right up to "she looks too happy on her facebook pictures, her rape must not have been that nonconsensual!" Making it more acceptably part of the legal process would not decrease these abuses in the rape culture of America today.
On a broader note, there is no place for codifying degrees of the victim's blame, which is a subjective matter that cannot and will not be made satisfactorily objective, in a legal system created to punish perpetrators.
