Parents of Ga. girl locked in chicken coop face charges

An adopted girl from Georgia was allegedly held in a chicken coop and forced to wear a shock collar as punishment for not doing chores.

CBS News reported that the girl was being home-schooled in a house outside Butler, around 85 miles south of Atlanta. She was adopted in 2007. Parents Samuel and Diana Franklin were arrested on Tuesday and released on bond.

According to WTVM.com, the girl told police that she had to wear a shock collar for dogs around her neck, and it was used on her several times. Officials found the collar in the Franklin’s home when they were arrested.

A neighbor said that Diana Franklin only fed the 15-year-old girl bread and water as punishment for days. According to the neighbor, Diana Franklin said she was "doing what the Bible says."

The girl said she spent up to six days at a time in a small outhouse and chicken coop in the back of the Franklin’s property, according to Special Agent Wayne Smith of the Georgia Bureau of Investigation. Smith said the outhouse was only 4 feet long and wide, and just a few feet high, according to the Associated Press.

The girl said she had been kept in the buildings for the past two years.

According to Mail Online, Diana Franklin faces 12 counts of cruelty to children and four counts of false imprisonment, and husband Samuel Franklin could see eight counts of cruelty to children and eight more of false imprisonment. The girl has been placed in temporary custody of the Department of Family and Child Services.

At the 2012 senior citizens’ law day conference, Lawrence A. Friedman, Bridgewater elder law attorney, said elders need to protect their children of prior marriages from being disinherited. "Even if your spouse’s current will provides for your children, your spouse may change it after you pass away,” he said. In addition to protecting one's child, an appropriate will can minimize N.J. estate taxes, which kick in if assets are over $675,000. At the conference, Cathyanne Pisciotta from North Brunswick discussed guardianship which could be necessary if various legal documents are not signed. Pisciotta said that if a person does not have a durable power of attorney (for financial affairs) and a living will (for medical decisions), anyone else can seek guardianship of that person. An expensive court proceeding is mandatory. And she said, “If one person seeks guardianship, someone else can challenge the appointment. Another relative may seek to be appointed guardian because he/she wants the money and power.”
