Actually they do deserve a free pass. It's in the Constitution that congressmen traveling to DC (which he was at the time) are afforded "by law" to travel unimpeaded. Specifically, "The Senators and Representatives shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same." U.S. Constitution, Article I, Section 6
