Terry Lakin is defying President Obama the wrong way

Army Lt. Col. Terrence Lakin has vowed not to obey military orders until President Obama shows he is constitutionally-eligible to sit in the Oval Office as President by producing a birth certificate. As a result of his comments, the Army has threatened to jail Lakin and to dismiss him.

This Army officer has no choice but to obey all of Obama's orders. He took a vow to do this as did all other offers in the military. Obama is the commander-in-chief and he is the President and he is to be obeyed...unless it's found he shouldn't be in the office.

Lakin has been ordered to report to Fort Campbell, Ky. on April 12 and, according to a "counseling form" warning issued by the Army, if Lakin fails to follow his "reassignment and/or deployment orders may result in adverse action including court-martial," according to "counselor," Lt. Col. William D. Judd.

In the warning, articles 86, 87, and 88 of the Uniform Code of Military Justice were quoted. These articles cite being missing, disobeying an order, and contempt, which — if found guilty — "you could be sentenced to dismissal from the service ... forfeiture of all pay and allowances; and confinement for a period of months or years in a military prison."

However, Lakin is allegedly being supported by "hundreds" of people who have donated to his legal defense fund. Lakin said he decided not to obey orders after he said he unsuccessfully went through channels to get the same verification from the president that he said he has been required to provide during his 18-year career.

Being a member of the military, he is under orders to obey the commander-in-chief. If he doesn't believe the chief is the current sitting president he can't just disobey orders. He must go through legal channels to unseat the president. Lakin doesn't have the luxury other citizens of the United States have. We can yell and bitch all we want because we are not members of the military.

That's the way it is, Colonel. You can't change the system your way. You have to change the system within the system. That's the American way.

But what a helluva mess we'll have if it's shown Obama is not legally POTUS.

18 years in, is the precise reason why he doesn't want to go overseas. Been there, done that. You think you're homefree and going to retire nice and pretty without having to disrupt you life one more time. After 1 day, 1 month, 1 year, 10 years of serving overseas, once you're done mentally, you're done!
He was ROAD (retired on active duty, for those unfamiliar with the expression) and he thought he as going to ride out the last two years.

The day Obama became president he was obeying Obama's orders. Everything about his job is a reflection of the President's policies and objectives. Every order that comes down comes from the TOP. So if he had an issue with Obama he should've raised the issue last January. Don't wait until your life is getting ready to be uprooted to make a big stink about it.

The military may drop is deployment orders, but they're going to drop his rank, retirement, and paycheck along with it. I hope it was worth it. I hope your family feels as strongly about the thought of having a black man, err, a "foreigner" tell you what to do. I hope it's worth being stripped of your career. This is laughable. Eventually stupid does reveal itself. Don't expect a pardon on this one!

The verbal oath of office for Active duty officers does not have "obey the orders of the President", but the National Guard officers oath does.

HOWEVER, the commissioning certificate does in fact put all commissioned officers on notice that they serve at the discretion of, and must obey the orders of the President.

People that think Obama is not a citizen not only look incredibly stupid not realizing Hawaii is in fact part of the United States, but you also demean every single member of Congress, and every other elected official for thinking you've somehow pointed out something they've missed.
Go back to school, read a map, and stop being bigots and racists. Not once has a President's natural birth been questioned. It's incredibly ridiculous AFTER he's produced the certificate of live birth, and the State of Hawaii has produced it for the million dumb-dumbs that have requested it. You want to disprove Hawaii isn't a state, that Obama wasn't born there, or that he doesn't have a real birth certificate--Go ahead. The rest of us will be getting on with our lives in the meantime.

Birthers have the same arguments... all which have been debunked.

Wrong. The oath of U.S. officers is to the United States Constitution.

The Nuremberg Trials set THE prescient that officers who follow illegal orders are as guilty as if they acted alone in the matter of war crimes (and that can include perceived war crimes where a domestic or foreign court decides what you or I to be legitimate is judged to be a crime).

Also, isn't it true that Obama promised in 2007 that he'd "bring all the troops home if any troops remained in Iraq or Afghanistan if and when he became president? Obama is a liar. Why should I believe that Obama believes he was born in Hawaii? Besides, Obama is an Indonesian citizen and has been since 1967 and thus has no rights to even be here in the U.S.

Obama himself also claims to have been a dual British-U.S. Citizen from birth to age 21. Can anyone explain how a dual citizen can also be a "natural born" citizen? (NOTE: I said "natural born," NOT "native born." Natural born is the Constitutional requirement, not native born.)

The Army has already backed down from one soldier who believed he was getting illegal orders to deploy. Stefan Frederick Cook was ordered to deploy; refused and his orders were withdrawn.
Obama may have been born in Hawaii, but he has not submitted proof. (The scanned document that was posted on the web would not be accepted as proof of birth for little league baseball, much less any legal issue.)
By his own admission, he is not a natural born citizen (read Vattel and US Constitution).
I think a lot of people simply want the truth. Many just want our leaders to be subject to the same rules and laws that we are. And many others, myself included, would like to see our country obey our Constitution.
My hope... the truth will set us free.

why would Obama not put the controversy to rest by showing his long form birth certificate? And why would the Army have revoked the orders of Maj. Stefan Frederick Cook when he took the first such stance, rather than going to trial or furnishing incontrovertible proof of O's natural born status? I can only imagine one thing that could persuade the Army to back off in such a situation, as it is not a forgiving institution; The only possible reason I can see is, they knew if they pushed further the judge would make them furnish proof Obama does not have. I don't see how this conclusion can be chalked up to racism, zealotry or delusion - rather it seems to constitute glaring circumstantial evidence. Logically, it seems those people who are sick of "birthers" should join them in asking Obama to furnish conclusive evidence of his status - aka his long form birth certificate - as this would placate and disband the "birthers" in a heartbeat. But I suspect on some level they too can sense the awful truth, are afraid of it, and so can only take refuge in vituperation. As for the legitimacy of orders, all military authority flows from the commander in chief. If he's not truly eligible, then there is no commander in chief and the whole chain of command is broken - so Lakin is only screwed if he's wrong. But again, if he's wrong, why not simply show the long form and get on with it - why all the need for threats of court-martial, etc. - threats the army has already belied as described above. If you can think of any logical alternative explanations of the facts I've presented here, please let me know. Thank you.

This country was founded by similarly courageous men who were willing to sacrifice their fortunes, reputations, honor and even their lives resisting TYRANNY-consistent and aggressive violations of liberty. You girly men hush up-you criticize because you bear the guilt that comes with cowardice! How else can you justify your inaction at a time like this!?

I commend LTC for standing up for what he believes in. There is plenty of doubt surrounding Obama's eligibility to hold the office of the POTUS. I say his risk is really not that great. I don't think DoD will push it to trial for risk of Obama's lawyers being forced into discovery, as he has already spent in excess of 2,000,000 to keep his records sealed. But he might want to spend some of that money on how to figure on keeping his wife's mouth shut.

For the liberal American hating morons posting here, as a former combat vet, officers take a different oath than enlisted men. Their oath is to the Constitution, period. Only in the enlisted man's oath does it include the POTUS. Reason for this is a system of checks and balances against an out of control CIC who clearly violates the UCMJ. Refusing to produce your records and spending 2 million taxpayer dollars in doing so is, when there is overwhelming evidence showing you to be an impostor, is a valid reason for any officer to demand proof as well as the millions of citizens who own America and have asked for production. Violating the Constitution makes the
POTUS and his tyrannical cabal, traitors, when he and many others around him admitted he has at best dual citizenship, as his father was a British citizen when he was hatched. That fact alone disqualifies this enemy of the state to go about destroying America! The founders specifically addressed the issue of dual loyalties as disqualifying a person from seeking the office of POTUS! The MSM, the judiciary, the Congress and the criminal supporting class are in on the fix. The de-facto POTUS is a moslem with no demonstrated cultural connection to America as he apologizes and bows his way across the globe throwing our allies under the bus, while supporting and emboldening terrorist states. Even his wife and one of the top ministers of Kenya have admitted in public that his homeland is Kenya and he was born there. Col. Lakin is a hero, those of you who don't see that are cowards and traitors! I took an oath, I will never abandon that oath, for to do so is treason!

I don't know what Obama has to hide, he has spent over $2 million to avoid producing a birth certificate. Why would he do that? It just defies logic and to me raises an obvious red flag. Not to mention barry was also adopted by an indonesian, went to public school there and if you understand the dual citizenship laws of the time it makes his citizenship very questionable. I don't know the answers but I do know there is enough evidence that it should be in court.. before he replaces the supreme court justice..

This is a case of an officer of the United States Military who swore an oath to "...support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God." In this case the officer is refusing to faithfully discharge the duties of his office in violation of the oath he took before God. He is attempting to evade the obligation he took freely. And his reason for doing this is not that he has been ordered to violate his oath or that he has been ordered to commit war crimes. This comes at a time when he has been ordered to deploy to another part of the world to support the mission of the military to defend the United States against a foreign enemy. Mr. Lakin also states that deploying at this time will harm his career and his future. Amid all this he wants us to think a conspiracy about the legitimacy of the President is the real reason? Go ahead and throw your life away, Mr. Lakin.

Barack Obama was born in Honolulu, Hawaii (yes birthers, that IS part of the United States). He is a natural born citizen, eligible to be and IS the President of the United States. The birthers are a small group of non-thinking, non-rational, racist conspiracy nuts who cannot get over a black man in the White House. This goofball Lakin had better have showed up today or he should be prosecuted, dishonorably discharged, and have his medical licenses revoked. That is the truth.

Incidentally, it is a federal crime to solicit or encourage members of the military to disobey orders.

I hope there is room in jail for his cheering section.

In response to the last poster (Chilidog), LTC Lakin has served 18 years in the military. Why at 18 years of service and only 2 years to qualify for retirement would a highly respected US Army Flight Surgeon decide to give it up? Because he is trying to get out of overseas service? LTC Larkin served in Afghanistan while stationed with the Aviation Brigade I was assigned in 2004 and 2005. This soldier is only standing up for what he honestly believes is unjust. While I would never do the same, he has taken it upon himself to have the truth revealed. Why documents still have not been released after such controversy, is beyond me. I would like to know for 100% certainty that President Obama is eligible for the position he currently holds. But I will not risk my career to question it. But without a doubt, LTC Larkin is not trying to get out of overseas duty. Someone does not serve 18 years in the military just to give it up so easily to get out of a deployment.

The fundamental flaw in LTC Lakin's argument is that it is the President who issues his orders. The orders are issued under the authority of the Army. As such, they are presumed to be lawful, and anyone who disobeys does so at their peril -- at least that's what military law says. Some years ago Michael New decided to refuse to wear the United Nations blue beret. He went to court-martial. Said the order was illegal -- nope said the courts, including the U.S. Supreme Court. Sorry gov., you don't get to pick and choose on orders. True there is a very very tiny gap for "patently unlawful orders" and this is what's getting soldiers who kill in Iraq and A/Stan into trouble.
I notice that there are other "orders" that LTC Lakin believes are lawful, such as the orders to pay him -- huh?

Who cares what this loser thinks. All he wants is to get out of serving overseas.
