N.J. Death with Dignity Act would be first assisted dying law on East Coast

A bill is being proposed in New Jersey that would allow terminally ill people to self-administer medications that would end their life in a dignified manner.

Democratic Assemblyman John Burzichelli introduced the Death With Dignity Act. Assisting another person with suicide in New Jersey is currently a crime.

According to the Los Angeles Times, a person would have six months or less to live and would need to make at least two verbal requests and one written request to receive the medication. Two doctors have to certify that the patient is terminally ill, and the same two doctors have to assure that the person is making the decision voluntarily, and send the patient to counseling first.

There would be a 15-day waiting period after the first request is made, according to Burzichelli's measure. He told CBS New York, “People should have the right, in my opinion, to control their body. This is a matter of personal conscience, a matter of personal faith, and a matter of personal choice.”

Patients who had impaired judgment will not be eligible for the law, according to Newsmax, and hospitals maintain the right to forbid their doctors from writing the prescription for the fatal amount of medication.

Burzichelli is uncertain if the final version of his measure will need a public referendum.

Oregon and Washington are currently the only U.S. states that have the right-to-die law, according  to gantdaily.com. Since it took effect in Oregon in 1997, 596 people have died from self-administered drugs. The law passed in 2009 in Washington, and 213 people have made the choice.

Control over your own existence is the ultimate basic human right.

In the 18 years this law has been in effect here in Oregon, none of the slippery slope arguments against this act have come to pass. Instead, terminally ill, suffering people have found an exit from life that not only benefits them, but their families as well. In most states it would be a crime to be present loving and comforting their loved one as they ended their own suffering.

Once you have been diagnosed with less than 6 months to live by 2 doctors, you can be prescribed the meds. From that point on, it is up to you whether and when you take the fatal dose. If you feel better after six months, great! Keep on going! Many people who get the meds, don't end up using them, but find it a comfort to know that they have the option.

There is no God orchestrating who gets born and who dies. Suffering is not in itself a noble act. This is a fallacious argument made by religion to ease the pain of suffering, much like drugs. If it helps you to believe these things,fine.
But the religious convictions of some, should not be used to prevent this act from benefitting others.

I live in Oregon and am proud and relieved to have this law in effect.

Mercy killing, not matter how well intended is wrong. Only God gives life; only God has the right to take it away. No doctor or patient can determine with absolutely certainty when someone is going to die, unless they take a person's death into their own hands. As a medical professional for several decades I am aware there have been numerous patients who have been told they only have a few months to live and then they live for years and often do get better. Aids, Advanced Stage Cancer, head injuries, Swine Flu Virus and even Multiple Sclerosis are but just a few examples. For those of the Judeo Christian belief and morals, suffering is NOT Meaningless but individuals and their families and even society can grow and learn from it. A wrong means cannot make a right resolution - that is utilitarianism and we all know where Hitler and 9/11 took that...religious humane convictions that it is ok to kilol, even with a suicidal "hero" killing themselves does not make it morally right. It is doubtful this bill will get through both houses or be signed by the Governor...

A big flaw is to let the same doctors be the ones involved in decision making and dispensing the lethal medications. How is this different from some prisoners on death row who want to die because they don't want to be in prison the rest of their lives? A patient who is very ill can be delirious on pain medications and it would naturally be expected they will be quite depressed. Are they in a right mind to make such a decision?

Hospitals wold be exempt but down the road will doctors and nurses and hospitals be forced to comply when a law like this, is amended in a few years? What is next? Mercy klling is
not as merciful as it sounds, whether at the doctors' hands in dispensing lethal medications or the patient who chooses to take them.

An expensive court proceeding is mandatory. And she said, “If one person seeks guardianship, someone else can challenge the appointment. Another relative may seek to be appointed guardian because he/she wants the money and power.”
