Atco Raceway is being sued by the widow of a man who died after his car crashed into a wall at the track. Evelyn Cruz of Brooklyn is seeking $50 million in damages from Atco Raceway and the National Hot Rod Association, the group that sanctions auto races.
Her husband, Jose Cruz, 51, was drag racing at Atco on Sept. 15, 2010, when he hit the track wall and his car went up in flames. Raceway officials told the Courier-Post that emergency medical technicians, ambulances and fire trucks are on site for races. But according to the lawsuit, the ambulance wouldn’t start after Cruz’s vehicle caught fire. The complaint alleges that Cruz’s son, the track’s owner and his family had to run to the accident scene and extinguish the fire.
Cruz suffered second- and third-degree burns and both of his legs were amputated, according to philly.com. Cruz died 10 months after the crash on July 11, 2011, his attorney said.
Atco Raceway owner Joe Sway Sr. said the track’s ambulance was functional and responded. Sway added that "the driver was out of the car by the time the first responder got to him."
Atco Raceway hosts about 250 events every year, and has been around since 1960. The track bills itself as the busiest in the country.
