Spitting man forces JCPD officers to get health check

BY WILL COLLINS

After being spit on and injured during the struggle to handcuff a man suspected to be on PCP this Saturday, 6 Jersey City Police officers are now receiving medical treatment.

Police were attempting to serve Terrance Smith, 30, with a temporary restraining order from his ex-girlfriend when he became uncontrollable, according to NJ.com.  His ex-girlfriend called the police to Freemont Street once she realized that Smith was in the area.

Upon arrival, it was apparent to the police that Smith had been using drugs, and he became irate when the officers tried to hand him the papers showing proof of the temporary restraining order.  Smith then began to flail his arms at the police, which called for multiple officers to grab him and help to restrain him.

One officer fell, hitting his head on a curb, while another injured his hand during the arrest; however, nj.com reports that x-rays confirmed that the officers were okay.  During the ambulance ride, the police report stated, Smith was forced to wear a ‘spit mask’ because he continued to spit at officers even after they restrained him.

Aside from the physical injuries sustained by two officers, six of them were treated for exposure to blood and saliva as well.

Terrance Smith is now charged with aggravated assault on police officers, throwing bodily fluids at officers, resisting arrest, obstructing, and being under the influence of drugs.

Children can be conned out of inheritance after multiple marriages

BY CAROL ABAYA NEWJERSEYNEWSROOM.COM THE SANDWICH GENERATION Multiple marriages and blended families can mean children get cheated out of money and assets their parent(s) earned and had before the second or third marriage. At the 2012 senior citizens’ law day conference, Lawrence A. Friedman, Bridgewater elder law attorney, said elders need to protect their children of prior marriages from being disinherited. "Even if your spouse’s current will provides for your children, your spouse may change it after you pass away,” he said. In addition to protecting one's child, an appropriate will can minimize N.J. estate taxes, which kick in if assets are over $675,000. At the conference, Cathyanne Pisciotta from North Brunswick discussed guardianship which could be necessary if various legal documents are not signed. Pisciotta said that if a person does not have a durable power of attorney (for financial affairs) and a living will (for medical decisions), anyone else can seek guardianship of that person. An expensive court proceeding is mandatory. And she said, “If one person seeks guardianship, someone else can challenge the appointment. Another relative may seek to be appointed guardian because he/she wants the money and power.”
